Hello,
My wife has worked for a small Italian fashion company for approx 15 months.
they have, or had, 4 permanent emplyees based in New York city.
They have other offices around in Asia and Europe.
She advised her management in Italy in September that she was pregnant.
initially she was congratulated, then about a month after her telling management, things started to change.
At no point prior to this was it made obvious that the company were not doing very well or that things were
aboutt o change,
In April, the office manager walked out on the team and was fired shortly afterwards ro gross misconduct. We have seen an email from the company lawyer to her explaining that she was in total breach of contract.
a month after my wife told the company she was pregnantm it was suddenly announced that the office manager was being brought back as a vice president. Immediately after she started, there were new rules put in place that completely undermined my wife. her role had completely changed.
on 20th october, my wife asked the management what their policy was inregards to maternity leave. she was told they were looking into it and they would get back to her.
she reminded them about it a week later, on monday november 3rd, and was ignored.
On Tuesday november 4th, my wife was told that she was no longer required by the compmay, and she was being let go, because of resizing of the company.
On Thursday november 6th, my wife witnessed the companies financial people coming to the office to discuss expoanding the showroom, and hiring more staff.
Today, Friday 7th november, my wife actually had to take calls from people phoning up for interviews.
She today received a letter confiming that they were not in a position to continue her employment because of a decrease in sales and revnues for the company.
it stated that because of the downsixing efforts, they were forced to terminate her eployment as of next week.
She has not been offered any severance package.
does anyone think we have a fair chance at a pregnancy discrimination case or wrongful termination ?
