In a nutshell !!!!!!!!

1. I have been with same organization for 9 years excellent reviews.

2. Complained to HR 9 months ago about OT that was due me

3. March 09 .. I was called in and given a written warning about hanging up
on my boss and using the internet in a common work area. I catagorically denied
this and wrote a letter to HR (SAVED) to block me from this access on my system so
they can't just accuse me of this any time they want.

4. June 09. Was called in again after the letter I wrote to HR and was given a FINAL warning
about using the internet CHAT again. What are my rights if Wrongfullt terminated?

I once agin wrote a SECOND letter to HR the next day in regards to this.

I was not sure how far it has to go before legal assistance is neccessary.. do you think I
could have a case? your opinion? i haven't been fired yet but can feel it comming

If you get an attorney he may curtail a firing and legal expenses.

I am beginning to get frustrated, the last time you posted I sent you to an attorney you did not go. Now your asking questions on fees you need an attorney your hobbled without one. I cant make it any clearer.

What state are you located?,, how big is company, do they have an IT person on staff. Ask to see your emp. file and request copies of all docs. inside. You have copies of all reviews? get them. Request a meeting with HR div mgr and your immediate manager, and a non-management 3rd person. Have you used up all vac/sic time, meaning will you loose it if fired? Personal time? Maybe request a family LOA. Get your ducks in a row... This doesn't look good.

Contact IT dept. and get your password changed, log in changed. See if they have (and they do) records of your past activity on the comp. Maybe someone else is logging in on your comp or using your passwords. Also if your on a network, shared, others are able to see your activity while your online.

Mass is an "AT-will" state, they dont need a reason to fire you, but they ARE starting a paper trail on you.

They accusing me of being on the internet is false and I addressed a letter to HR telling them
to block access... This in my opinion would NOT disqualify me from Unemployment .. I was not
in any deliberate misconduct or knowing violation of there policy and sent 2 letters in regards to this
which I saved.

Your HR dept is not connected to the IT (tech support) or is it? You need a new password, only use your computer, I've been in this situation before, I had a meeting with HR director, not the specialist, also included was my manager and a co-worker. We went over policy, talked about sharing computers, 30 day passwords in code scripted into software program, Policy was re-explained to all employees and we all had to sign doc. and given a copy. My employer claimed it was a form a stealing, getting paid for not "working", use of company assets for non-company use. Had I not have the meeting, I would have been walking. I kept the meeting professional in attitude, adding in my career goals and continued success for the company growth. You want them to know you are an asset and a team player. I hope this helps.
