In the last few days my husband has been demoted and now has recieved a cut in pay. When he questioned why all he was told is it was because of write ups that he has never seen and that one was a write up for not being at a company party that he did not go to after work. When he asked about the other write ups and the one about not going to the party his employer just walked a way. he has been employed there over 12 yrs, with out a pay raise or cost of living increase in over 3 yrs. any advise would be great.

What state? The employer can demote or reduce salary on monies not earned yet, but if the reduction is severe enough in some states it gives rise to filing a partial unemployment claim. Also there are other employee protections that could come into play given how all the facts roll out.

Contact an employment law attorney and do an intake with the intake specialist, after that if there is any type of action that can be pursued you would be called in for a consultation.

We need information about the hiring process; the racial, sexual, and national origin composition of the workplace; what is normal and expected in the relationship between workers and management; the age of the individual; and a hell of a lot more.

Joe’s advice is good. Seeing a plaintiff’s side employment law attorney is a great way to find out if you have a colorable claim, and the initial consultation is almost always free.
