My friend just recently had her baby on May 20, 2009. She went on leave (presumably PDL) on April 27, 2009.

After doing a song and dance with HR as to what kind of leave she was using when and trying to get paper work in order (which at the time of this writing, HR still hadn't squared away) it was understood with HR and Aetna that the return to work date would be August 12, 2009; she was only going to take 3 months. HR even said she could take the extra 4 weeks if she agreed, but she declined. ...

I live in Indiana and work at a State University.

Last year I went on FMLA due to going on dialysis. This is an intermittant leave and I do miss work from time to time. Normally this comes to a day to a day and a half per month for checkups. I do regular dialysis at home during the night. Last year my manager seemed to relax my work related tasks so that I could settle back into the position after being in the hospital for over a month and having my whole life change. We even discussed ...

My wife is on short-term disability as we are fighting breast cancer. In the past 4 months she's been through a mastectomy, and has started her chemo.

Two weeks ago her doctor signed approved her moving to long-term disability. My wife let her boss at work know about this and the response from her boss was that she would look out for the new paperwork.

We received the LT-disability forms yesterday and today being a treatment day at the hospital (the day her chemo is administered) we ...

All employees in NJ have started paying into this plan as of 1/1/09. Effective on 7/1/09 The Act allows for up to 6 weeks PAID leave for covered employees (which is pretty much everyone who works in the State) to Bond with a child or care for a family member with a serious health condition.

I nor my HR people have, as of yet ,been able to determine the % rate of payout for this plan. I would venture to guess that it would be a little less than the normal State STD payments would be as the ...

You wouldn't know it by how employers treat it, but the FMLA is a remedial statute that must be broadly construed to effectuate its humanitarian purpose. And the purpose of the FMLA is "to entitle employees to take reasonable leave for medical reasons," and to help working men and women "balance the demands of the work place with the needs of families." 29 U.S.C. § 2601(b)(1) and (2). The FMLA is about family values, about allowing workers to be responsible spouses and parents. ...

The Department of Labor released revised final regulations under the FMLA, which will take effect January 19, 2009. The DOL's webpage on the new regs can be found here:

http://www.dol.gov/esa/whd/fmla/finalrule.htm

The changes seem to offer important clarifications, make leave practices and requirements more uniform, and expand employee rights only in the context of servicemembers. There's lots of good background info on the DOL's webpage, so check it out.

Asking this for a friend.

Kyle's girlfriend is due to give birth to their first child in late December. around the 20th, and Kyle is considering taking some time off, say a month, to be at home with the baby. Like me he works retail so he was thinking that he'd wait until January 1 to start the leave (basically be gone all of January) to help with post Christmas Chaos. Seems reasonable to the three of us.

He wants to go in and talk to the boss this week about taking the time off. ...

I am pregnant and have started to take disability for my pregnancy due to the severe morning sickness. I have had my doctor completed all the forms and so forth. My question is, if I have started to take disability leave Sept 1, what are my options if I am unable to return to work until 8 weeks later. I received a letter from my HR saying FMLA and PDL run concurrently and that FMLA only allows for 12weeks of leave while PDL allows 88 working days of leave, BUT they run concurrently. Is it true ...

If I have a Dr's note for longer than 90 days can my company terminate me before the end of the 90 days and not pay me my benefits because they know I will be out longer than 90 days? Would it be easier to get a Dr.'s note for exactly 90 days, to get the benefits, then have them terminate me on day 91? TIA
