When I was offered a position at with this employer, it was less than 70% of my prior employer. The position I had applied for was management but when offered I was a sales rep. I was told I was going to be working on the campaign I had applied for after I had learned the basic on a different campaign.

All the previous contracts they had continued giving these increases even after the contract was up and in negotiations. However this year they halted all increases after sept 30th.
My company has hired several people to fill vague positions that were never posted and don't have a job description. These people may be earning near the same or more than me. I have been there 26 years. I am a successful sales manager and have, needless to say, vast experience with this company. I have been asking for additional responsibilities (training new sales staff, working with other divisions, etc) for years. I have been able to do some of that (with good feedback).
I wanted to take a moment to share with everyone, here on this board, the situation I am currently dealing with. Back in July I had a union business agent ("BA") come out to the job site because of a workplace issue. The employer discharged me only hours later. The BA did nothing about this and I have filed an unfair labor practice against the company. The only problem is I don't have very good evidence to prove that I was terminated for engaging in union activity. I know the other ...

Larry Whitten earns the Nazi cbg award for being an asshole. He marched into this northern New Mexico town in late July on a mission: resurrect a failing hotel.

At which point he immediately laid down some new rules. Among them, forbidding the Hispanic workers at the run-down, Southwestern adobe-style hotel from speaking Spanish in his presence (he thought they'd be talking about him), and ordered some to Anglicize their names.

I would suspect that before cowboying on in to New Mexico ...

Union leader arrested, charged with bribery

WASHINGTON — The president of a national railroad employees union was arrested at his Ohio home on Tuesday and charged with bribery.

Edward Rodzwicz, who heads the Brotherhood of Locomotive Engineers and Trainmen, is accused of soliciting and accepting $20,000 in bribes from a St. Louis lawyer. In exchange, prosecutors say, Rodzwicz allowed the lawyer to remain on a list of attorneys approved to handle injury cases for union members.

Please define/explain the term "defect of process" as it relates to an Unemployment Appeal. My initial thought is that it implies a violation of commission regulations (to which you previously linked me to, thanks) during the course of proceeding.

I just want to be clear in my understanding.

Would it be permissible and how difficult would it be for a layperson, whom is unfamiliar with court proceedings, to bring a case to the civil division of the superior court pro se rather than going through small claims? I am hesitant to go through small claims court as I understand the cases are not always heard by judes and they many times are not well versed on CA labor laws.

If you are awarded benefits and it is later determined (4 months later) that you were not qualified for such benefits do you have to pay them back and if so, how do you know? Do they include that as part of the determination letter or do they wait until all appeals have been exhausted and last decision is final...

Also, if repayment is necessary, how do they go about collecting it? 4 months of benefits is a big chunk of money for lump sum payment and what if person is still unemployed?

Thanks,

Topic moved from employment law

Where can I find the "rules" that the hearings, appeals etc. are governed by?

By rules, I mean what the officer/judge/referee (or whatever title he/she esteems themself with) must, can and can't do during a hearing, like recording the session, admitting evidence, swearing in witnesses, objections etc.

Is that outlined in the statute, can I request them from the local office or do I have to belong to the secret society known as the ESC?
