pto/ lunch break in NJ

Post  stressed_out41 on Fri Dec 05, 2008 5:38 pm

The company ive worked for for the past 2 years was just bought out by another group. They laid off all employees with in three months of taking over. The only one remaining is myself. Im running two locations (they are within two mi. of another) Im charged for lunch but yet am not given the time to take one. Im doing the same job that five girls use to do and do not get one penny more. I bring work home now (3-5)hrs a wk. Im literally having a nervous breakdown, I need the income right now and am thankful Istill have a job but am worried of loosing my job if I say something to my boss. Also when you accumulate pto hours is It a law that the selling company must pay you out for the hours you have earned?

thanks for any input!

Are you paid by the hour or are you salaried?

I was hired as front desk receptionist but after they laid everyone off I really had no choice but to step into management position "unofficially" but with the same hourly wage

Check with an attorney someone is pumping the pooch,on this work at home without pay. Sounds like they are calling you a manager to beat you out of overtime.

Yep. And if properly reported to state/federal officials (an attorney would know the offices and the procedures probably), it slides into whistle blowing territory and that's federally protected.

So if one is actually fired (which would take some serious nerve by the employer) there's law suits major for wrongful discharge. Might even be able to get enough money to handle the bills until a better job is arranged.

Again, an attorney would have the details so find one right away.
